Trusts and societies

Build the compliance worklist from the governing document, jurisdiction and activities of the organisation.

Identify the governing framework

A trust deed and a society’s memorandum and rules establish different governance records. The applicable state framework and registering authority must be identified before selecting forms, renewal steps or change procedures.

Track status separately from tax treatment

Registration of the organisation does not by itself establish every tax benefit or permission for overseas funding. Keep each approval and its conditions distinct from the founding document. Foreign-contribution questions require review before accepting relevant funds.

The government’s FCRA explanation describes registration or prior permission for eligible associations receiving foreign contribution. Assess the proposed receipt and the organisation’s actual permission before accepting funds; incorporation or a founding document does not settle that question.

Keep an accountable record

  • Trustee or governing-body membership and decision records.
  • Donation and grant restrictions with utilisation evidence.
  • Property and investment documents.
  • Accounts, returns and authority correspondence.

Changes to review

New trustees, office bearers, objects, premises or funding sources may require document and authority updates. A decision recorded internally should be checked for any further registration or notification step.

How we begin

Share the governing document, state, activities and approval history. Kosha can organise the record and recurring worklist, while legal interpretation of the deed, state law and restricted funding is referred to the appropriate adviser.

Prepare a governing-body handover

Keep the current governing document, membership records and signed decisions together with a list of open authority correspondence. Identify who holds the original property and registration documents, who maintains the accounts and who can explain ongoing programme commitments.

When an office bearer changes, the incoming person should receive an outstanding-actions list as well as completed records. Distinguish a decision already taken from a document still awaiting signature or a communication not yet sent, so unfinished work is not lost between teams.

Connect programme records to the accounts

Bookkeeping and monthly close can organise receipts, spending and reconciliations for the agreed period. Supply grant or donation instructions with the transaction records so the accounting team can identify questions about how funds have been allocated.

For example, a programme coordinator may describe a receipt as unrestricted while the donor’s letter names a specific project. Preserve both records and resolve the difference with the responsible person before preparing a utilisation statement. The working file should record the basis ultimately used.

The state and union territory directory provides a starting point for local context. The organisation’s actual governing framework and authority records determine which further questions need specialist review.
