1. Scope
This Policy applies to fees paid to Kosha.Services for HR, labour, GST, accounting, income tax, TDS, ROC, legal, corporate compliance, advisory, documentation, and related professional services. If a signed proposal, invoice, order form, or written agreement contains different refund terms, that document will apply to the relevant engagement.
2. General Refund Rule
Paid service fees are generally non-refundable once work has commenced, deliverables have been prepared, filings have been initiated, meetings have been completed, or our team has allocated professional time to the engagement. This includes monthly compliance retainers, one-time advisory assignments, documentation work, filing support, review work, and urgent compliance tasks.
3. When a Refund May Be Considered
- A duplicate payment was made for the same invoice or service.
- You paid an advance and cancelled before any work, review, document request, filing preparation, consultation, or resource allocation began.
- We are unable to start the agreed service for reasons within our control and no meaningful work has been performed.
- A refund is required by applicable law or by a specific written agreement signed by the parties.
Where a partial refund is approved, we may deduct fees for work already performed, time spent, consultations completed, documents reviewed, third-party costs, taxes, payment gateway fees, and out-of-pocket expenses.
4. Non-Refundable Items
- Government fees, statutory charges, challans, penalties, late fees, stamp duty, filing fees, and portal charges.
- Third-party fees, payment gateway charges, courier charges, professional partner costs, bank charges, and vendor fees.
- Consultation fees, review fees, urgent work fees, documentation fees, or advisory fees after the session or work has started.
- Recurring professional fees for the current agreed billing period once it has started, subject to section 3 and the package-specific cancellation terms below.
- Fees for completed deliverables, submitted filings, draft documents, compliance calendars, reports, registers, or advisory notes.
- Amounts paid for services delayed because the client did not provide complete information, approvals, access, documents, or timely responses.
5. Cancellation of Services
Request cancellation in writing before the next billing period or project milestone starts. A cancellation request stops neither an existing statutory deadline nor work already authorised; confirm the effective end date and any handover in writing.
- Essential Compliance Desk
- Essential is billed in three-month periods. Request cancellation before the next quarter begins. The current quarter remains the paid service period unless we agree a different end date in writing. Leaving part-way through a quarter does not automatically create a pro-rata refund.
- Growth Compliance Partner
- Growth has an initial six-month minimum term. Its payment schedule is stated in the proposal; the minimum does not itself require payment of all six months upfront. Cancellation during that term does not by itself shorten it or waive the agreed fees for its remainder. After the minimum term, give notice before the next agreed billing period begins.
- One-time work
- The proposal identifies the stages and payment milestones. Cancellation is assessed against work performed and authorised commitments, rather than applying a recurring-package minimum.
These rules do not remove the refund grounds in section 3 or rights under applicable law. A written variation can change the end date or final charges. The final account identifies fees earned, outstanding agreed fees, third-party commitments and any approved credit or refund; the same work or cost must not be charged twice. Read the matching pricing and billing terms.
6. Billing Disputes
Please report an incorrect charge within seven days after the later of the invoice date and payment date. If you discover an error later, report it promptly; this requested reporting window does not waive any rights available under applicable law.
Identify the invoice, disputed amount and reason. Keep sensitive records out of the initial public-form message; we can identify the supporting records needed for the review. A dispute about one item should identify that item separately from undisputed work.
7. Refund Request Process
- Request: send your name, business name, invoice reference, payment date, amount and reason through the contact form or your existing engagement contact. An on-screen confirmation means the enquiry was received, not that the refund was approved.
- Review arrangements: establish the person handling the request, any missing information and a next review date in writing. There is no fixed approval deadline under this policy. If timing matters, ask for the review date when the request is acknowledged; the processing period below does not start at submission.
- Assessment: the review considers the agreed scope, actual work, payment records and third-party commitments. The outcome should state the approved amount or reason for declining it and itemise deductions. If further information is needed, the next step and review date should be recorded.
- Payment: approved refunds are normally processed within 7 to 14 business days after written approval, subject to bank, payment gateway and reconciliation timelines. Payment normally uses the original method unless another method is agreed in writing.
- Follow-up: if the stated review date passes or you disagree with the outcome, refer to the original request and ask your engagement contact for reconsideration. You can also use the contact form or write to the company address below.
8. Taxes and Credit Notes
Any refund, adjustment, or credit note involving GST, TDS, or other tax treatment will be handled in accordance with applicable law and our accounting records. Tax amounts already deposited, reported, or subject to statutory restrictions may not be refundable in cash.
9. Changes to This Policy
We may update this Refund Policy from time to time. The latest version will be posted on this page with an updated effective date. Changes apply prospectively unless required by law. This version does not replace different terms already agreed for an existing engagement.
