Regulatory

Pollution consent applicability

Assess pollution permissions for the actual site, process and capacity before installation or operation. Company registration and a general trade licence do not establish that environmental consent requirements have been met.

Describe the operating process

Prepare a process flow showing raw materials, equipment, production capacity, water use, fuel, emissions, effluent and waste. Include utilities and support operations such as boilers, generators, washing or surface treatment.

A business description such as assembly may conceal an additional cleaning or coating process that changes the assessment. Review what happens on the premises rather than relying only on the industry name selected during incorporation.

Identify the competent authority

Locate the relevant State Pollution Control Board or Pollution Control Committee and its current consent process. Review the applicable central framework together with local implementation, siting conditions and activity restrictions.

Keep consent to establish, consent to operate, environmental clearance and waste authorisations distinct. A permission under one framework should not automatically be treated as satisfying all the others.

Check classification and exemptions

Use the current industrial classification and the precise conditions of any exemption. Recent reforms affect consent requirements and procedures, so an older category list or validity table may not describe the present position.

Where a white-category or other exemption is relied on, retain the classification basis and complete any applicable intimation or registration. An exemption from consent does not remove pollution-control standards or unrelated waste-management obligations.

Build the site evidence pack

  • Entity details and authority to use the premises.
  • Site plan, location and relevant land-use information.
  • Process flow and installed or proposed capacity.
  • Water balance, effluent treatment and disposal arrangements.
  • Fuel use, emission sources and control equipment.
  • Waste types, quantities and authorised handling arrangements.
  • Existing clearances, consents and compliance reports.
  • Proposed changes to equipment, capacity or process.

Separate establishment and operation

Determine which approvals are required before construction or installation and which conditions must be satisfied before operation. Where environmental-clearance-related exemptions apply, document the exact provision and remaining obligations.

Do not interpret an application acknowledgement as permission to begin. Read the granted order, its scope and conditions, and confirm that it covers the actual equipment, activity and capacity.

Maintain the operating conditions

Turn consent conditions into a practical register of monitoring, recordkeeping, reporting and maintenance tasks. Assign owners for sampling, treatment-system operation, waste movements and responses to authority directions.

For example, an approval may cover a stated production capacity and effluent arrangement. Adding a new production line or changing discharge arrangements should trigger a review before the change is implemented.

Manage amendments and continuing validity

Check the operative consent framework and the terms of the site’s order for validity, fees, changes and continuing compliance. Do not copy renewal assumptions from another state or an outdated national summary.

Retain the issued permission, application pack, monitoring results and correspondence together. Kosha.Services can help organise the applicability and document checklist with the relevant environmental professionals; provide the actual process and site facts at the outset.
