Tax dispute document checklist

Build a dated, indexed evidence file for a tax notice, assessment or appeal so that every response can be traced to the underlying records.

Identify the proceeding before collecting everything

Read the full notice or order, including annexures. Record the taxpayer, registration, tax period, issuing authority, provision cited, reference number, service date and required action. Distinguish a request for information, proposed adjustment, assessment order and recovery communication.

Authenticate the communication through the relevant official service where available. Preserve the original electronic file and evidence of receipt. A forwarded message or screenshot may omit annexures and dates needed to understand the proceeding.

Create a deadline and authority sheet

Record the response or appeal deadline from the applicable law and actual service facts. Identify the authorised representative and the person responsible for approving factual statements. Different remedies can have different time limits and filing requirements.

An adjournment request, grievance or informal discussion should not be treated as an extension unless the applicable process supports it and the necessary confirmation exists. Assess appeal, payment, stay and rectification questions separately instead of assuming one action automatically resolves the others.

Assemble the core document set

  • The complete notice or order, annexures and proof of service.
  • Returns, computations and audit reports for the relevant period.
  • Ledgers and reconciliations tied to the disputed amount.
  • Contracts, invoices, delivery or service evidence and bank records.
  • Tax payments, credit records and prior adjustments.
  • Earlier submissions, acknowledgements, hearing records and correspondence.
  • Authority to represent the taxpayer and any required declarations.

Organise evidence by issue

Make one issue sheet for each disputed adjustment or question. State the authority’s position, the taxpayer’s factual explanation, the supporting documents and the legal question. Cross-reference numbered annexures and reconcile every material figure to a source.

Keep unfavourable or inconsistent evidence in the internal file and resolve it honestly. Do not alter original records, backdate documents or label a reconstruction as a contemporaneous record. Where evidence is missing, explain the gap and identify possible independent corroboration.

Prepare a response that can be checked

Answer the actual questions in order, with concise facts and the relevant calculation. Separate factual assertions from legal submissions and state the relief or action requested. Avoid uploading a large undifferentiated folder that leaves the reader to discover the argument.

The Income Tax Department’s e-Proceedings service supports viewing communications, responses and adjournment requests. Use the procedure relevant to the specific notice; GST, customs and other proceedings have their own channels and requirements.

Example: an invoice total differs from reported turnover

Build a bridge from invoice totals to the return figure, identifying credit notes, cancellations, timing differences and other supported adjustments. Attach the documents that explain each difference and show how the adjusted total reconciles.

If part of the difference remains unexplained, keep it visible and investigate rather than forcing the reconciliation to balance. An arithmetic match is useful evidence, but it does not independently establish the legal treatment of the underlying supply or income.

Preserve proof of filing and the next step

Save the exact submitted response, annexures, acknowledgement, filing date and reference number. Confirm that attachments are readable and complete. Record any portal error and the steps taken to use an authorised alternative process; a saved draft is not a submitted response.

After an order, update the file with the outcome, demand calculation and available next steps. Maintain a separate schedule for payment, appeal and any stay conditions. Keep the case open until the relevant actions and evidence are complete.

What this checklist does not decide

The correct legal position, remedy, limitation calculation and payment or deposit requirement depend on the tax, period and proceeding. This checklist organises the evidence needed for that assessment; it does not imply that every notice can be answered through the same form or that a challenge suspends recovery.

For an ongoing dispute, share the complete communication and receipt date with the adviser first, then provide the indexed evidence file through an agreed secure channel.
