Define the legacy-tax work
We identify the tax, jurisdiction, period and current proceeding, reconstruct the document chronology and coordinate the agreed response or reconciliation work. Current GST procedures are not assumed to govern older matters.
Identify the original taxpayer and registration, the authority involved and the latest available procedural document. Record whether the immediate task is understanding a demand, locating missing records or preparing an agreed response. Keep separate proceedings and periods distinct even when they concern the same business.
Records needed for a useful assessment
- Original notices and orders
- proof of service
- historical returns and challans
- accounts
- prior submissions
- appeal and stay records.
Build a dated chronology linking each notice, response, payment and order to its supporting record. Note documents held by former advisers and distinguish an unavailable copy from an event that has not been established. Reconstructed schedules should identify their sources and limitations rather than appear to be original contemporaneous records.
A transaction detail that matters
An old demand still needs its original legal and factual context. A modern GST ledger cannot substitute for the records relating to the disputed legacy period.
For example, an amount carried forward in the accounts may combine an original demand, later payment and adjustment. Reconcile those components to the relevant orders and payment evidence before describing the outstanding position. The current ledger balance alone does not establish the procedural status or available remedy.
What your proposal will cover
Availability of records, limitation questions and representation are assessed before accepting a mandate. Specialist litigation is separately agreed.
The written engagement identifies the legacy tax registrations, jurisdictions, periods, proceedings and responsibilities. Government payments and professional charges are identified separately.
The handover contains the chronology, indexed records, reconciled amounts and unresolved document or procedural questions. Identify the next action, its responsible person and any separately required representation mandate. A reconstructed file helps assess the matter; it does not revive an expired remedy or establish that a demand has been discharged.
References and official procedures
This directory helps locate central indirect-tax materials. State VAT matters require the relevant state legislation and orders. Identify the provisions and amendments applicable to the original period; current GST registration rules do not establish the treatment of a legacy matter.
