GST appeals

Organise the GST order, disputed amount and supporting record for the appropriate appellate stage.

Approach and deliverables

We identify the order being challenged and reconcile the demand, admitted amounts and payment history. First appeal and tribunal proceedings have different procedural requirements and should not be treated as one portal task.

The engagement can cover grounds, facts, indexed exhibits and filing coordination. Pre-deposit and payment linkage are reviewed against the actual demand record and current portal procedure.

Prepare a demand bridge by order reference and tax period, distinguishing the amounts shown in the order from payments and adjustments recorded elsewhere. Keep differences visible until the source records explain them; an internal net balance should not replace the underlying demand history.

Records for the case file

  • Complete order and service evidence
  • Demand ledger and payment references
  • Notice, replies and hearing records
  • Invoices and reconciliations relevant to disputed findings

Index exhibits against the findings being challenged. Preserve notice attachments, the replies actually filed and hearing correspondence as a single chronology. Where a payment reference appears in more than one working schedule, check that it has not been counted twice.

A practical example

A voluntary payment made earlier may need reconciliation with the demand identifier before preparing the appeal payment file. Retain the original payment and adjustment evidence.

For example, a payment may appear in the cash ledger while the case file records a different adjustment status. Retain both records and identify the unresolved linkage rather than assuming that a cash deposit alone answers how the amount relates to the disputed order.

Engagement boundaries

The applicable forum, limitation and deposit requirements must be checked for the order. Portal submission alone does not prove every filing condition has been met or guarantee relief.

The proposal states the period, procedural stage, drafting and appearance work included. Share the deadline during intake; a public enquiry does not appoint a representative or extend any statutory time limit.

The handover distinguishes the appeal documents prepared, the submission acknowledged and any further procedural step still outstanding. Assign an owner for portal communications and preserve the final grounds and exhibit set so later work starts from the filed record.

Keep the acknowledgement with the appeal file

The GST portal FAQ for an appeal against a demand order distinguishes submission from admission and describes the final acknowledgement in Form GST APL-02. Retain that document with the submitted grounds and exhibits rather than relying only on a submission status or notification.

This guidance concerns the first-appeal portal workflow. Confirm the applicable filing conditions for the actual order and forum; tribunal proceedings need their own procedural check.
