Use the current establishment legislation

Assam’s Labour Welfare Department publishes the Assam Shops and Establishment Act, 2022, alongside amendments dated 2025 and 2026. Some registration and renewal instructions still refer to the 1971 Act. Read the current instrument and its commencement and transition provisions before applying an older service-page deadline or fee.

The Commissionerate provides an EODB application route and guidance for a combined trade-licence and establishment-registration application. Keep each issued approval and its conditions: a combined application does not make the permissions interchangeable.

Keep profession-tax registration and enrolment distinct

The Commissionerate of Taxes portal provides profession-tax registration information and a separate enrolment guide. Assess the employer’s deduction responsibilities separately from the liability of the business or professional under the applicable schedule.

Maintain employee salary classifications, deduction calculations, payment references and return acknowledgements. Document exemptions and effective periods. When staff move between states, reconcile their actual work location with payroll settings rather than copying the previous state’s tax treatment.

Treat plantation welfare as a separate workstream

Assam has a Tea Employees Welfare Board and a tea-plantation welfare fund. The state describes funding through several sources, including employee, employer and government contributions. This is a sector-specific framework; it is not a basis for applying a tea-plantation deduction to every office or retailer in Assam.

For a tea business, separate plantation-worker records, factory operations, trading offices and contractor deployment. Check the applicable welfare and provident-fund framework for each workforce, together with current notifications. Construction work at a garden also needs its own assessment.

Match premises approvals to the local authority

  • Identify whether the site falls under Guwahati Municipal Corporation, another municipal body or an industrial-area authority.
  • Check permitted land use, building occupancy and fire requirements before signing off the operating layout.
  • Assess Pollution Control Board, Assam permissions for the actual process, discharge and waste.
  • Track food, legal-metrology or other sector requirements separately from the general trade licence.
  • Record changes in address, ownership, activity and workforce against each affected approval.

Example: tea trading with a new packaging unit

A tea trader opening a packaging unit should distinguish bought-and-sold inventory from goods processed at the new site. Review premises use, machinery, food-business permissions and employment records before production starts. Buying tea from gardens does not itself make the trading office a plantation or establish coverage under plantation welfare schemes.

Prepare an operating compliance file

Keep entity authorisations, premises evidence, workforce details, issued certificates and tax records by location. Record the source and effective date used for each obligation, especially where portal instructions refer to older legislation. Kosha can coordinate accounting and administrative records with the technical advisers responsible for premises and process approvals.
