Resolve the establishment-law transition first
Bihar’s official digital repository lists a 2026 Act repealing the Bihar Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2025. At the same time, ServiceOnline retains older shops-registration descriptions and offers a newer establishment-registration form. An available form alone does not establish which law governs your application.
Before filing, identify the effective instrument, savings for existing registrations or proceedings, and the applicable establishment category. Do not reuse a 2025 worker threshold or assume that repeal automatically revives an earlier law. Keep the department’s current application instructions with the establishment file.
Separate employer registration from profession-tax enrolment
Bihar’s Commercial Taxes Department administers profession tax. Its official business-services guide distinguishes the employer’s registration from enrolment for persons whose liability is not discharged through salary or wage deductions. Assess the business and its employees separately against the applicable schedule and exemptions.
Prepare entity and authorised-person identification, address evidence, bank details and the relevant application. Reconcile deductions with payroll and retain tax payments and returns by period. A GST registration is not evidence that profession-tax registration, enrolment or payment has been completed.
Choose the correct district and premises authority
The state application services ask for district and subdivision information. Use the actual workplace and responsible office, rather than routing every Bihar establishment through Patna. A registered office, shop, warehouse and production unit may create different local responsibilities.
- Document ownership or lease rights and permitted use before committing to premises.
- Identify the municipal body or industrial-area authority responsible for trade and building permissions.
- Assess fire, environmental and factory permissions against the process, storage and workforce.
- Keep sector registrations, such as food-business permissions, linked to the correct operator and location.
Keep welfare and payroll records specific to the activity
Construction-worker welfare and sector-specific worker benefits should not be treated as a universal payroll deduction. Record the applicable scheme, responsible party and legal basis before making deductions or contributions. Keep wage, attendance, leave and contractor records available even while a registration application is being processed.
An interstate employee transfer needs a fresh state-tax assessment. Carrying forward the previous state’s profession-tax settings can produce an incorrect deduction or missed payment.
Example: a distributor opening a processing unit
A distributor adding food processing in another district should map the new establishment, food licence, environmental requirements and premises permissions before operations begin. Track the new location in payroll and accounts, and check whether existing tax registrations need an amendment. A shop certificate for the original sales office does not demonstrate approval for the processing operation.
Create a usable operating file
Keep the law and notification relied on, issued registrations, application acknowledgements, payment records and authority correspondence together. Assign an owner to address, activity and workforce changes. Kosha can coordinate accounting, tax and administrative records with the technical professionals responsible for premises and sector certification.
