Check the March 2026 establishment exemption first

Puducherry’s Gazette notification of 15 March 2026 exempts shops and establishments registered under the Occupational Safety, Health and Working Conditions Code, 2020 from section 7 registration and the other provisions of the Puducherry Shops and Establishments Act, 1964, subject to its conditions.

The employer must comply with the Code’s applicable duties, records and returns. The notification preserves actions and proceedings initiated before publication. Establish whether the business actually has the relevant Code registration before relying on this exemption; an ordinary portal account or another licence is not enough.

Use the service appropriate to the establishment

The Labour Department provides shops, catering and motor-transport registration and renewal services alongside factory, construction and contractor services. Identify the activity and current framework before selecting an application.

For establishments outside the March 2026 exemption, check the applicable registration and renewal procedure. Keep the issued certificate, conditions and change-of-particulars records together. Extended opening and night work also require consideration of the relevant conditions, rather than an assumption based solely on registration.

Assess municipal profession tax

Puducherry’s Local Administration Department publishes the Municipalities (Profession Tax) Rules, 1976 and related profession-tax legislation. Identify the local body responsible for the workplace and assess the current schedule, exemptions and payment requirements.

Keep the employer’s salary-deduction responsibilities and the business or professional’s own assessment clear. Reconcile payroll, assessment and payment evidence by period. GST registration is not evidence of profession-tax payment.

Identify the regional and local authority

Puducherry, Karaikal, Mahe and Yanam are geographically separate regions of the Union Territory. Use the actual operating address to identify labour and local-body jurisdiction. Do not apply the neighbouring state’s rules merely because a workplace is near or surrounded by that state.

Check land use, occupancy, building, fire and environmental permissions for the premises. Food, hospitality, healthcare, manufacturing and other regulated activities can require additional approvals.

Example: a business opening an outlet in another region

A Puducherry operator opening a Mahe outlet should map the new premises, local authority, workforce and applicable tax records before trading. Keep stock transfers and outlet sales identifiable. The original establishment certificate does not automatically demonstrate that all requirements for the new site have been met.

Maintain workforce and change records

Keep employment terms, attendance, wages, leave and contractor evidence under the applicable framework. Assess construction-worker welfare and other social-security obligations separately; do not use a generic welfare deduction without a legal basis.

Record registration status, permissions and amendment responsibilities by location. Kosha can coordinate accounting, payroll and administrative evidence with the technical professionals responsible for premises and process approvals.
