Check trade-licence eligibility and the issuing authority

Sikkim’s SSO service directory provides a Gangtok Municipal Corporation trade-licence service specifically for businesses within its jurisdiction. For other locations, identify the responsible municipal, block or other authority rather than assuming the Gangtok process applies statewide.

The corporation’s circular register lists the Sikkim Trade License and Miscellaneous Provisions (Amendment) Rules, 2025. Check the current eligibility, ownership and operating conditions before choosing the applicant or signing a business arrangement. A private agreement does not establish that a licence can be transferred or used by a different operator.

Apply separately for the establishment certificate

The SSO directory identifies shop and commercial-establishment registration and renewal as a Labour Department service. The detailed service listing requests applicable trade licences and, for an existing registered establishment, the earlier booklet. Prepare consistent entity, premises and activity information across these records.

Keep the trade permission, establishment certificate and any sector licences as distinct approvals. Track changes in address, ownership, workforce or activity against the particulars recorded in each.

Identify worker-registration requirements

The Labour Department describes worker registration under Sikkim’s labour-protection framework and lists a broad range of occupations. Assess the current requirements for the workforce and any service provider or contractor; employer registration and an individual worker’s record answer different questions.

Maintain employment terms, attendance, wages, leave and contractor deployment evidence. Construction-worker benefits and other social-security schemes should be assessed separately, with the legal basis recorded before any welfare deduction is applied.

Keep profession-tax records independent of other tax treatment

Sikkim’s Commercial Tax Division identifies the Sikkim Tax on Professions, Trades, Callings and Employment Act, 2006 among its administered laws. The SSO directory also provides a profession-tax service. Assess the applicable person, employment and schedule, including current exclusions and amendments.

Do not infer exemption from profession tax merely from a separate income-tax position or local status document. Maintain calculations and payment evidence for the relevant period and distinguish the employer’s responsibilities from those of the business or professional.

Example: a shop adding a food counter

Before adding food preparation to an existing shop, check whether the licensed activities and premises conditions need to change. Review food-business, fire, waste and utility requirements and update establishment particulars where necessary. Keep sales, stock and expenses for the added activity identifiable so the accounting and tax treatment can be assessed.

Prepare a location file before opening

  • Applicant and entity documents, including authority to operate the business.
  • Premises rights and relevant land, building and occupancy permissions.
  • Trade and establishment certificates and their conditions.
  • Workforce and contractor records, including applicable registrations.
  • Profession-tax calculations, acknowledgements and payment evidence.
  • A schedule for amendments, renewals and responsibility for authority queries.
