GST reverse charge applicability

Reverse charge places the tax-payment responsibility on the recipient for specified supplies. Check the transaction, supplier and recipient conditions in the operative notification before configuring the purchase ledger.

Read the notification as a complete test

Identify the goods or services, supplier category, recipient category, location and date. Reverse-charge notifications specify combinations of these conditions; matching only a broad expense name is not enough. Read amendments and effective dates with the original notification.

Notification 13/2017-Central Tax (Rate) is a starting instrument for specified services, while goods and integrated-tax cases have their own instruments. The original 2017 text should not be treated as a complete current list without subsequent amendments.

Do not use registration status as the only rule

A supplier being unregistered does not automatically make every purchase subject to reverse charge. Assess the applicable specified-supply or notified-recipient provisions and exemptions. Equally, a supplier’s registration does not by itself rule out reverse charge.

For example, a legal-services invoice requires review of the actual supplier, recipient and applicable entry rather than an automatic decision based on whether the invoice displays a GSTIN. Preserve the engagement facts and the source used for the classification.

Build a transaction assessment sheet

  • Supplier identity, legal status and registration details where relevant.
  • Recipient entity and GSTIN responsible for the supply.
  • Description, contract and invoice supporting the actual transaction.
  • Applicable notification entry, amendment and effective period.
  • Exemption, option or other condition and the evidence supporting it.
  • Tax rate, value, place of supply, tax head and time-of-supply conclusion.

Determine timing and documents

Check the time-of-supply rule applicable to the transaction, including payment and invoice dates and any special cases. Do not assume that the accounting posting month always determines the tax period. Keep the date evidence used in the calculation.

Assess whether self-invoicing, a payment voucher or another document is required for the particular supply. Use the operative rules and current time limits; not every reverse-charge transaction calls for identical paperwork.

Separate payment from credit

Calculate and discharge the reverse-charge liability through the permitted payment route. Review the relevant cash-payment requirement rather than assuming existing input credit can settle it. Preserve the return and ledger evidence connecting the payment to the period.

Then assess whether input-tax credit of the tax paid is available, when it may be taken and whether restrictions or reversals apply. A payment does not automatically establish full credit entitlement. Record the credit decision separately from the liability decision.

Reconcile the purchase population

Review expense, asset, advance and related-party ledgers for potentially relevant transactions. A check limited to invoices already marked “RCM” can miss items classified incorrectly at entry. Compare the assessment register to returns and payment records.

Investigate overseas services separately where relevant. Establish the nature of the supply and parties before treating every foreign payment as an import of services. Bank charges, reimbursements and bundled arrangements may require additional facts.

Correct omissions with a dated trail

If a missed transaction is found, identify its original tax period, amount and applicable consequences. Preserve the original entry and document the correction, payment and any associated credit treatment. Do not silently move a historical liability into the current period to hide the delay.

Bring contracts, purchase ledgers, invoices, payment dates, returns and prior classification notes to Kosha.Services. We can organise the review population and reconcile the resulting liabilities, with notification conditions checked for each relevant category and period.
