Use the current establishment application route
Jammu and Kashmir’s single-window system publishes a shops-and-establishments registration procedure, and JanSugam lists the corresponding service. Prepare the employer, activity, premises and workforce information for the current application.
The Labour Commissioner’s orders register includes a 2025 temporary offline permission issued during a single-window outage. Treat such an order as a dated exception: check the currently authorised route instead of assuming that an old outage notice permanently changes the process. Retain the application and issued certificate separately.
Check the law applicable to the current period
Older forms and manuals can retain names or procedures from before reorganisation. Identify the legislation, adaptation and current notification governing the actual transaction before relying on historical requirements.
Jammu and Kashmir and Ladakh are separate Union Territories. A Jammu and Kashmir service or certificate should not be assumed to cover a workplace in Ladakh. Keep the relevant jurisdiction and operating address clear in the entity and employment records.
Map industrial permissions before operations
The Industries and Commerce Department provides industrial guidance and access to the single-window framework. Separate permission to establish and operate a unit from eligibility for an incentive scheme. Scheme registration is not evidence that building, labour or environmental approvals are complete.
Assess land rights, permitted use, building approval, fire, power, water and pollution requirements against the actual process and capacity. A warehouse, food-processing unit and manufacturing plant require different supporting facts.
Maintain workforce and payroll evidence
- Employment terms, workplace allocation and attendance records.
- Wage classifications, leave and period-wise payment calculations.
- Contractor and principal-employer responsibilities for deployed labour.
- Applicable worker-welfare and social-security registration and payment evidence.
- A documented profession-tax and deduction assessment rather than assumptions copied from another jurisdiction.
- Inspection responses, corrective actions and changes in establishment particulars.
Example: a seasonal business adding year-round processing
A seasonal trader adding a permanent processing line should reassess the premises, machinery, workforce and environmental position before production. Keep purchased stock, production inputs and finished goods distinguishable. Update affected registrations and account for staff working outside the original seasonal period. The original trading registration does not establish approval for manufacturing.
Keep a site-specific responsibility register
Record the issuing authority, certificate scope, conditions and amendment responsibilities for every workplace. Track authority queries and payment acknowledgements without treating a pending application as approval. Kosha can coordinate accounting, tax and administrative evidence with the professionals responsible for land, process and technical certification.
