Separate the establishment and premises questions

Maharashtra’s Labour Department lists services under the Shops and Establishments Act, 2017. Assess registration or intimation using the current worker-count and activity rules, including exemptions. Do not reuse an old 1948 Act application checklist.

The relevant local body also matters. Mumbai’s municipal service route is not a universal application route for Pune, Nagpur or an MIDC industrial site. Identify the planning authority, permitted building use and occupancy evidence before committing to premises.

Treat PTRC and PTEC as separate assessments

Maharashtra’s profession-tax system distinguishes registration and enrolment. Assess the employer’s deduction and payment responsibilities separately from enrolment liability of the business or relevant persons. Keep certificates, payroll calculations, payments and returns matched to the correct account.

Use MAHAGST’s current notifications and the taxpayer’s filing periodicity for the relevant financial year. A portal relaxation or extension should be checked against its stated scope rather than applied to every taxpayer or period.

Check labour welfare and employment records

Review Maharashtra Labour Welfare Fund coverage with the Labour Welfare Board for the establishment and eligible employees. Keep the assessed contribution period, worker population and payment evidence distinct from professional tax and national payroll obligations.

Maintain wage, attendance, leave and working-time records under the applicable regime. For labour-code transitions, distinguish a consultation draft from a commenced rule and record the instrument supporting a changed payroll or employment process.

Build the local permission register

  • Municipal or industrial-authority permissions for premises use and the actual trade.
  • Building, fire and utility evidence applicable to the site.
  • Maharashtra Pollution Control Board consents and waste permissions for relevant processes.
  • Activity-specific food, health, excise or legal-metrology permissions where needed.
  • Certificate conditions, change notifications and renewal owners.

Example: opening a second branch

A Mumbai business opening a Pune branch should assess the new premises and establishment records, employee allocation and profession-tax account requirements. Its existing certificates should be checked for scope rather than assumed to cover every location. Keep payroll and branch accounts reconcilable to the underlying registrations.

Prepare for filing and ongoing changes

Gather entity records, signatory authority, occupancy documents, activity details, employee information and existing certificates. Record changes in workforce, address or activity when they occur. Kosha can support accounting and administrative coordination alongside the professionals responsible for technical or statutory certifications.
