Identify the actual working arrangement
Distinguish occasional home working, a permanent home-based role, work from a different Indian state and work from another country. Record the employing entity, usual workplace, proposed location, expected duration and duties. The company’s registered office is not a sufficient description of every employee’s circumstances.
This guide is a workflow for reviewing those facts. It does not establish that a home address automatically needs a business registration or that an existing registration covers every remote location. Those conclusions depend on the applicable law and the activity carried on there.
Assess an interstate move before payroll closes
Give HR and payroll a change request with the effective date and new address. Review the relevant state rules for professional tax, labour welfare fund, establishment coverage, holidays and employment conditions. Record why an obligation applies or does not apply rather than copying the previous state’s deductions.
For example, an employee who moves from Bengaluru to Pune for a permanent arrangement needs a documented location review. Simply changing the mailing address while leaving all payroll settings untouched may miss an applicable change; automatically opening a new establishment registration may also be premature.
Treat international work as a separate decision
Before authorising work abroad, review immigration and permission to work, local employment obligations, payroll withholding, social security and the business’s potential tax presence. An individual’s right to enter a country should not be assumed to authorise employment there. Obtain advice for the destination country and the actual duties.
The Income Tax Department’s non-resident guidance distinguishes the relevant tax period and residence rules. Keep a travel-day record and assess the employee’s residence and income treatment for that period; do not infer tax residence from nationality, payment currency or the location of the employer alone.
Flag authority to negotiate or conclude contracts, senior management duties, customer-facing work and an employer-funded workplace for a business-tax review. These are review inputs, not an automatic conclusion that a permanent establishment exists.
Put workable operating terms in writing
- Approved location, duration, working hours and how changes must be requested.
- Reporting, availability and attendance arrangements that fit the role and applicable requirements.
- Equipment ownership, support, reimbursement approval and return arrangements.
- Confidentiality, approved storage, device security and incident reporting.
- Emergency contact and a practical process for raising workplace concerns.
- What happens when the approved arrangement ends or the employee changes location again.
Maintain evidence without excessive surveillance
Keep the approved request, address and date history, review conclusions, payroll instructions and employee acknowledgement in a restricted file. Collect information needed for the decision and explain its use. Routine compliance records do not require continuous monitoring of a person’s private surroundings.
Reconcile payroll changes against the approved effective date and retain the applicable filing or payment evidence. For covered provident-fund arrangements, use EPFO employer processes and employee records rather than assuming remote status removes membership or contribution responsibilities.
Review exceptions and close the loop
Create an escalation route for an unapproved move, an extended overseas stay or a change in role. Gather the actual dates and activities first, then assess corrections and future conditions. Do not invent a retrospective approval or overwrite the original location history.
At return or exit, update payroll inputs, retrieve equipment, remove unnecessary access and preserve required records. A periodic employee confirmation can help identify changes, but it should complement a clear requirement to report a move promptly.
Kosha.Services can help build the location register, coordinate state payroll reviews and organise the facts for cross-border advisers. Bring the employment terms, travel history, role description, payroll records and proposed remote-work policy.
