Shops and establishments requirements

Shops and Establishments compliance depends on the state or union territory, the premises and the nature of the business. Establish the applicable process before applying, then maintain the employment and change records that follow.

Identify the law for each establishment

Prepare a list of offices, shops, branches and other operating premises. Record the activity, commencement date, worker count and responsible employer at each location. Assess the local definition of an establishment, exclusions and current notifications rather than treating incorporation or GST registration as the answer.

Registration, intimation and exemption are different outcomes. A workforce threshold relevant in one jurisdiction should not be copied into another. Check amendments and any interaction with registration under the occupational-safety framework for the particular state and period.

Use the official state process

Delhi’s Labour Department publishes an online Shops and Establishments registration service and guidance on working conditions. Maharashtra publishes registration and amendment services under its 2017 Act. These are examples of separate state processes, not a common national application.

Start from the current government department or single-window portal and verify the service description. An older form, model bill or archived guide may not reflect the operative requirements. Record the official source and the date checked in the establishment file.

Prepare a consistent application file

  • Entity name, constitution and relevant formation records.
  • Premises address and the possession or occupancy evidence requested by the authority.
  • Employer, manager and authorised signatory details.
  • Nature of activity, commencement date and workforce information.
  • Existing registration or intimation details where the application concerns a change.
  • Declarations, photographs and authorisation documents required by the applicable service.

Treat registration as the start of the record

Compare the issued certificate or acknowledgement with the submitted details and correct errors through the prescribed process. Retain the application, payment receipt where applicable, queries, responses and final document. Do not describe a submitted application as an issued registration.

Maintain the applicable employment records, notices and displays. Review working hours, rest intervals, weekly holidays, leave, wage records and any conditions attached to an exemption. Late opening or round-the-clock operation should be assessed against the actual notification and its safeguards, not assumed from the registration certificate.

Manage changes and branch growth

For example, a registered business opens a second shop in another city. Check whether that premises needs its own registration or intimation, and whether the first location’s particulars need amendment. A certificate for one address should not be assumed to cover all future branches.

Set a change checklist for a new address, employer or manager, activity change, workforce change and closure. Identify the applicable amendment, renewal or closure process and deadline from the current state requirements. Some systems use different validity arrangements, so do not create an annual renewal task without checking it.

Keep other approvals visible

A Shops and Establishments document does not by itself establish compliance with municipal trade licensing, permitted building use, fire safety, food licensing or sector-specific permissions. Maintain these in a separate premises approval register and link each requirement to the activity that triggers it.

For a home office, coworking arrangement or remote workforce, gather the facts about possession, control, customer visits and work actually performed. Obtain a location-specific assessment instead of assuming either automatic exemption or automatic registration.

What to bring to Kosha.Services

Bring the premises list, activity descriptions, employee counts, entity records, occupancy documents and existing certificates. Include any department notice or prior application that may affect the next step.

Kosha.Services can help organise the jurisdiction review, prepare an application checklist and maintain the amendment calendar. Fees, processing steps and employment conditions should be confirmed against the relevant current state service before filing.
