Check the establishment registration route

Delhi’s Labour Department provides online shops and establishments registration under the 1954 Act. Assess the actual business and current exemptions before applying. Where incorporation services have already generated a registration, verify the issued record before creating a duplicate.

An exemption from particular working-time provisions is not necessarily an exemption from the entire Act. Read the scope and conditions of the applicable notification and keep supporting evidence with employment records.

Identify the municipal jurisdiction and licence type

Confirm whether the premises falls within MCD, NDMC or cantonment jurisdiction. MCD’s general trade and storage licensing guidance addresses listed activities, while health-trade services cover separate categories. Select the process for the actual trade and authority rather than treating every office as the same business type.

Keep municipal permission distinct from labour registration, land-use compliance, building occupancy and fire requirements. A digitally issued licence does not remove the need to satisfy its conditions.

Review payroll and labour welfare on their own basis

Do not import a neighbouring state’s profession-tax schedule into Delhi payroll. Record the legal basis for each state or local deduction and reassess it when employees change workplace. National tax withholding and social-security obligations remain separate.

Delhi’s Labour Department identifies a Labour Welfare Fund framework. Assess its current establishment coverage and relevant obligations rather than equating it with construction-worker registration. Preserve the applicable notification before configuring contributions or other payments.

Prepare the premises and workforce file

• Entity, signatory and occupancy documents with the correct jurisdiction.
• Activity description and any storage, food, health or manufacturing component.
• Relevant trade, building, fire and Delhi Pollution Control Committee permissions.
• Employment terms, wage categories, attendance, leave and contractor records.
• Issued certificates, conditions, changes and renewal or inspection actions.

Example: an office becoming a public-facing outlet

An office that starts selling or storing goods for walk-in customers should review the actual trade, premises use and municipal requirements. Its shops registration alone does not answer those questions. Record the change in operations before filing amendments or seeking additional permissions.

Keep the NCR jurisdictions distinct

A Delhi entity operating in Noida or Gurugram must assess the Uttar Pradesh or Haryana workplace separately. Maintain location-specific records while consolidating accounts.
